APPLICANT REQUESTS THAT:

1.  His grade on his DD Form 214, Certificate of Release or Discharge from Active Duty, be changed from Airman First Class (A1C/E-4) to Staff Sergeant (SSgt/E-5). 

2.  He be awarded the Air Force Commendation Medal (AFCM). (Administratively Corrected) 



APPLICANT CONTENDS THAT:

He has one DD Form 214 reflecting the grade of SSgt and one reflecting A1C.  He believes SSgt was his correct grade.

STATEMENT OF FACTS:

The applicant initially entered the Regular Air Force on 20 May 63.  

On 1 Jun 66, the applicant was promoted to the grade of A1C under Special Order A-1061, dated 21 Jun 66.

On 3 Nov 66, the applicant was furnished an honorable discharge, and was credited with 3 years, 5 months, and 14 days of active service.   

On 25 Apr 14, AFPC/DPSIDR directed the applicant’s DD Form 214 be changed to reflect award of the AFCM.

AIR FORCE EVALUATION:

AFPC/DPSOE recommends denial of the applicant’s request to change his grade to SSgt on his DD Form 214, indicating there is no evidence of an error or an injustice.  The applicant’s official military record contains Special Order A-1061, dated 21 Jun 66, promoting him to A1C.  The record does not contain any official orders promoting him to SSgt, nor does it contain a second DD Form 214 reflecting his grade as SSgt at the time of discharge.  

A complete copy of the AFPC/DPSOE evaluation is at Exhibit C.

AFPC/DPSID administratively corrected the applicant’s record to reflect award of the Air Force Commendation Medal (AFCM).  No further action is required.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluations were forwarded to the applicant on 21 Jul 14 for review and comment within 30 days (Exhibit E).  As of this date, no response has been received by this office.



THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or regulations.

2.  The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice with respect to the applicant’s request to correct his records to reflect that he held the grade of staff sergeant (E-5).  We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of AFPC/DPSOE and adopt their rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice.  We note that AFPC/DPSID has verified the applicant’s entitlement to the Air Force Commendation Medal (AFCM) and corrected his records administratively.  Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting any relief beyond that rendered administratively.



THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
